Welcome to BarBank (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, platform, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

Who may use the Services

• You must be at least 21 years of age
• You must have the legal capacity to enter into binding agreements
• You agree that all information you provide is accurate and current
• You are responsible for maintaining the security of your account

Alcohol purchased through the Services is for personal enjoyment and is not intended for resale.

Marketplace and technology services

BarBank operates as a marketing, technology, and order-facilitation platform. We do not manufacture, sell, or ship alcoholic beverages. Alcoholic beverages offered through the Services are sold, fulfilled, and delivered by independently owned, properly licensed alcohol retailers in accordance with applicable law.

Seller of record disclosure

Orders placed through the Services are fulfilled by a licensed California ABC retailer, Vista Wine & Spirits, located at 10223 Prospect Ave, Suite A, Santee, CA 92071. The licensed retailer is the seller of record for alcoholic beverage transactions. Title to alcoholic beverages transfers at the retailer’s licensed premises, as required by law.

BarBank may facilitate payment processing, order transmission, marketing, and delivery coordination on the retailer’s behalf but does not take ownership of, or title to, alcoholic beverages.

Age verification & delivery

• You and the intended recipient must be 21 years of age or older
• A valid government-issued photo ID is required at delivery
• An adult signature is required; packages cannot be left unattended
• Failed age verification may result in cancellation, return, or additional fees

Purchases

• All orders are subject to acceptance by the licensed retailer
• Prices, availability, vintages, and product details may change without notice
• Applicable taxes, shipping, and compliance fees may apply
• You authorize charges submitted through the Services

Pre-orders

Some products may be offered for pre-order before they are in stock. Pre-order products are labeled as such, with an estimated ship date in the product description. The estimated date is our best estimate and is not a guarantee. Your payment method is charged at the time of purchase. Pre-orders ship as soon as the product becomes available; availability and ship dates may be delayed by manufacturing, supplier, or other circumstances beyond our control. To cancel a pre-order before it ships, contact support; refunds for canceled pre-orders follow our Refund & Return Policy.

Billing statements & chargebacks

If you believe a charge is incorrect, please contact us at support@barbank.com prior to initiating a chargeback. Unauthorized chargebacks may result in account suspension.

Delivery terms

• Alcohol shipping laws vary by state, city, and ZIP code
• Delivery timelines are estimates and not guaranteed
• Risk of loss and title transfer are governed by the licensed retailer’s terms
• Incorrect addresses or failed delivery attempts may incur additional fees

Website use and content

All original content, features, and functionality of the Services remain BarBank’s exclusive property. You may not distribute, republish, or use site content for public or commercial purposes without our written consent, and you may not interfere with the operation of the website or attempt unauthorized access to our systems or any linked systems. The Services may link to third-party sites that we do not control; use them at your own discretion under their own terms and privacy policies.

Accounts and termination

You are responsible for all activity under your account. Keep your password secure and notify us of any unauthorized use. We may suspend or terminate access to the Services for any reason, including a breach of these Terms; provisions concerning ownership, disclaimers, and limitations survive termination.

No warranties

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.

Liability limits

To the fullest extent permitted by law, BarBank shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Jurisdiction

These Terms are governed by the laws of the State of California, with exclusive venue in San Diego County, California.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
